Personal InjuryFlorida Auto Accident Claims

Florida motor-vehicle injury claims

After a serious car crash,
the insurance picture matters.

A Florida auto claim can involve the at-fault driver, a vehicle owner, an employer, multiple liability policies, personal injury protection, medical-payment coverage, and uninsured or underinsured motorist benefits. A careful investigation should identify every potentially responsible party and every applicable policy before the evidence and reporting records become harder to obtain.

The analysis begins with the people, vehicles, policies, and evidence connected to the collision.

  • Rear-end, intersection, lane-change, and highway collisions
  • Distracted, impaired, fatigued, or aggressive driving
  • Commercial, delivery, rental, and employer-owned vehicles
  • Passenger, pedestrian, bicyclist, and motorcyclist injuries
  • Multi-vehicle crashes and disputed fault
  • Catastrophic injury and wrongful-death claims

What the case may require

Liability, coverage, causation, and damages—investigated together.

01

Liability may extend beyond the person behind the wheel

Vehicle ownership, employment, agency, negligent entrustment, commercial operations, roadway conditions, and defective products can affect who may be responsible. The crash report is a starting point, not the complete liability investigation.

In a multi-vehicle collision, physical evidence, event data, video, witness accounts, and reconstruction may be needed to separate each driver’s conduct.

02

Florida claims involve several different insurance layers

PIP benefits, bodily-injury liability coverage, medical-payment coverage, health insurance, and UM/UIM benefits serve different purposes. The available recovery cannot be evaluated responsibly from the adverse driver’s declarations page alone.

Household policies, resident-relative status, vehicle ownership, employer coverage, rideshare activity, umbrella policies, and written UM selections or rejections may all matter.

03

Damages require organized proof

Medical causation, future treatment, lost earnings, diminished earning capacity, out-of-pocket expenses, pain, disability, and loss of normal life must be tied to reliable records and testimony.

Prior injuries do not automatically defeat a claim, but the medical evidence should distinguish a new injury, aggravation, or unchanged condition.

Crash evidence and insurance records can disappear, change, or become harder to obtain.

  • Crash report, body-camera footage, 911 audio, and citations
  • Scene, vehicle, roadway, debris, and injury photographs
  • Witness identities and contemporaneous statements
  • Vehicle event data, dash cameras, and nearby surveillance
  • Cellphone, employment, delivery, ownership, and maintenance records
  • Medical records, wage loss, expenses, and insurance documents

Florida auto-insurance framework

PIP and liability claims are related—but different.

Florida’s Motor Vehicle No-Fault Law requires qualifying policies to provide personal injury protection benefits. PIP addresses defined medical and disability losses without deciding the entire negligence claim.

A claim against an at-fault party and a UM/UIM claim require separate liability, coverage, causation, and damages analysis. Policy language and the facts of the crash control.

Review the current Florida TNC statute, UM/UIM statute, and PIP statute as applicable.

Should I speak with the other driver’s insurer?

Before giving a recorded statement, understand who is requesting it, what coverage is involved, and how the statement may be used. You may report basic facts without speculating about fault, injuries, or recovery.

What if the crash report says I was partly at fault?

The report does not necessarily resolve civil liability. Photographs, video, witnesses, vehicle data, roadway evidence, and Florida’s comparative-fault rules may affect the analysis.

How soon should the vehicles and video be preserved?

Immediately when the claim is serious or fault is disputed. Vehicles are repaired or sold, electronic data can be overwritten, and private video may be retained only briefly.
